Die Betreiber von Energienetzen sind verpflichtet, ihre Transport- und Verteilnetze für Strom und Gas Dritten zugänglich zu machen. Dabei müssen die eigenen Kosten zuzüglich einer angemessenen Gewinnmarge weitergegeben werden. Es ist nicht erlaubt, dass externe Energielieferanten benachteiligt werden im Vergleich zum eigenen Vertrieb (bei integrierten Energieversorgern). Im Kontext intelligenter Netze bedeutet dies, dass jeder Nutzer unter gleichen Bedingungen an das Netz angeschlossen werden muss.
